These Terms of Service ("Terms") govern your use of Flowmail, an email marketing automation service for Shopify brands operated by Brigitte Bettinardi. By using Flowmail, you agree to these Terms.

1. Service Description

Flowmail is a SaaS platform that provides AI-powered email marketing optimization for Shopify brands. Our services include:

• Automated email marketing audits of your Shopify store's Klaviyo setup
• Personalized audit reports with actionable recommendations
• Ongoing AI-driven optimization of email flows, segments, and campaigns
• Performance monitoring and revenue attribution

2. Subscription Terms

• Billing — subscriptions are billed monthly via Stripe. Your billing cycle starts on the date you subscribe.
• Cancel anytime — you can cancel your subscription at any time. Your access continues through the end of the current billing period.
• On termination — when your subscription ends, we stop active optimization of your email flows. Audit reports previously generated remain accessible for 90 days after cancellation.
• Price changes — we may adjust pricing with 30 days' written notice. Existing subscriptions continue at their current rate until the next renewal after the notice period.

3. Free Audit

We offer a free email marketing audit to prospective customers. The audit requires you to submit your Shopify store URL, name, email, and revenue range. The audit is provided at no cost and does not obligate you to subscribe. By requesting an audit, you consent to receiving up to 3 follow-up emails related to your audit results.

4. Acceptable Use

When using Flowmail, you agree to:

• Own or operate the Shopify store(s) you submit for audit or optimization. You must have authority to grant us access to the store's email marketing tools.
• No spam — you will not use Flowmail to send unsolicited commercial email or violate CAN-SPAM, GDPR, or any applicable anti-spam legislation.
• Accurate information — you will provide truthful and accurate information in all forms and communications.
• No misuse — you will not attempt to reverse-engineer, scrape, or abuse the service, or use it for any unlawful purpose.

5. Limitation of Liability

Audit findings are recommendations, not guarantees. Flowmail provides data-driven suggestions to improve your email marketing performance. We do not guarantee specific revenue increases, open rates, or conversion improvements. Results depend on many factors outside our control, including your product, audience, and market conditions.

To the maximum extent permitted by law, Flowmail's total liability to you for any claims arising from or related to the service is limited to the amount you paid us in the 3 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

6. Intellectual Property

You retain ownership of your store data and email content. We retain ownership of audit methodologies, AI models, and platform technology. Audit reports generated for you are licensed for your internal business use.

7. Refund Policy

Paid subscriptions are non-refundable for partial months. If you are unsatisfied within the first 14 days of your initial subscription, contact us at flowmail@polsia.app to request a full refund. After 14 days, no refunds are issued, but you may cancel to prevent future charges.

8. Availability

We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance or unforeseen outages may temporarily affect access. We are not liable for losses caused by service downtime.

9. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or a notice on our website at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.

10. Governing Law

These Terms are governed by the laws of the jurisdiction in which Flowmail operates. Disputes will be resolved through good-faith negotiation first, and if necessary, binding arbitration.
